Ernestinho Carioca
Last updated: October 2, 2026
At Ernestinho Carioca, we aim to help every traveller discover, organise and enjoy their experience in Rio de Janeiro with clear information, personal service and transparent terms.
This document sets out the general terms for using our website, requesting information, booking services and processing personal data. The specific terms of each booking will be communicated before payment and will form part of the agreement.
1. Identification and contact
Trading name: Ernestinho Carioca.
Person legally responsible for the activity and data processing: Ernesto Javier Dario Ojeda Aedo.
CNPJ: 40.414.859/0001-61.
Website: www.ernestinhocarioca.com.br.
WhatsApp: +55 21 96994-6938.
These channels may be used for enquiries, booking requests, changes, cancellations, complaints and matters relating to personal data.
2. Scope of our services
The website brings together information about Rio de Janeiro and presents tourism experiences, excursions, transport, short-term rentals and other travel-related products or services.
Depending on the agreed proposal, Ernestinho Carioca may provide the service directly, coordinate its delivery or participate in its sale with operators, guides, transport providers, property owners and other partners.
Before a booking is confirmed, the service, its inclusions, applicable terms and the provider's identity, where relevant, will be communicated. The involvement of partners does not exclude the responsibilities legally attributable to each party.
3. Published information and availability
We work to keep service descriptions, photographs, schedules and features up to date. Availability must be confirmed for the requested date.
The guide's editorial information provides guidance for organising a trip. The operation of establishments, access points and activities may change as a result of decisions by their managers or the authorities.
Photographs illustrate the places and experiences presented. Any essential feature expressly offered as part of a service must be honoured in the agreement.
Website updates will not unilaterally change the terms of an already confirmed booking.
4. Prices and included items
Unless expressly stated otherwise, prices are shown in Brazilian reais —R$—.
Each proposal must indicate whether the amount is per person, group, vehicle, night, boat or complete service.
Before payment, the following will be detailed:
- Total price and payment method.
- Included services.
- Admission tickets, fees and purchases payable separately.
- Deposit and outstanding balance.
- Change and cancellation terms.
Meals, drinks, personal purchases, tips, admission tickets and optional activities will only be included when expressly stated.
An offer accepted within its validity period and a confirmed booking will retain the agreed terms, without prejudice to subsequent changes requested and accepted by the parties.
5. Booking requests and confirmation
An enquiry or availability request does not, by itself, constitute a confirmed booking.
Confirmation will be provided in writing after availability has been checked, the specific terms have been agreed and the deposit has been received, where required.
The confirmation will identify, as applicable, the service or accommodation, date, number of participants, price, payments received, balance, meeting point and relevant instructions.
The customer must check the details and report any error promptly. Ernestinho Carioca will facilitate corrections and explain any possible consequences when a change affects services already booked.
6. Deposits and payment methods
As a general commercial condition, tourism experiences and services may require a deposit of 50 % of the total price, unless the proposal specifies a different amount.
For short-term rentals, the usual deposit is 20 % of the total price, subject to the property's and booking's terms.
When a 5 % surcharge for card payment applies, it will be disclosed before acceptance, showing the total for that payment method. Instalment or financing terms, if any, will be communicated separately.
Payments must be made exclusively to the recipients or payment links identified in the confirmation. If any account or payment instruction changes, we recommend verifying it through our usual customer service channel.
7. Changes and cancellations requested by the customer
Requests must be communicated in writing through the customer service channel used to make the booking.
Changes to dates, participants or services are subject to availability. Any price difference or associated expense will be disclosed before the change is confirmed.
Specific cancellation terms must be communicated before payment. Where a retention of funds applies, its grounds, calculation and relationship to commitments made for the booking will be disclosed, respecting legal limits and avoiding disproportionate charges.
A partner operator's terms must be provided to the customer when they form part of the agreement. Their application may not reduce rights recognised by the relevant legislation.
8. No-shows and late arrival
A no-show means that the customer fails to attend at the confirmed place and time without prior cancellation.
For tourism services whose proposal expressly provides for it, an amount equivalent to 50 % of the total agreed price may be retained, subject to applicable law and the proportionality of the penalty.
The treatment of any paid balance and additional amounts must be expressly disclosed in the booking.
For activities with group departures or timed entry, late arrival may prevent participation. If a problem arises, the customer should contact us as soon as possible to assess available alternatives.
Emergencies and justified impediments will be assessed individually.
9. Provider cancellations and weather conditions
Some activities depend on sea conditions, wind, visibility, access conditions, authorisations or safety criteria.
When a change or suspension affects a booking, the customer will be informed as soon as possible, with an explanation of the available alternatives and their financial consequences.
If a booked service cannot be provided, appropriate solutions will be offered, including rescheduling accepted by the customer, an agreed alternative or a refund of amounts relating to the service not provided.
Credit for future use will not replace a refund to which the customer is entitled without their acceptance.
Significant service changes must be communicated and may not be imposed to the detriment of the customer's rights.
10. Short-term rental terms
Each accommodation booking will be made through a specific confirmation identifying the property, check-in and check-out dates, maximum occupancy, price and rules of use.
Rates may vary according to dates, length of stay, season and number of guests.
The usual cleaning fee is R$ 300, unless the proposal specifies another amount or a waiver. Its inclusion or separate charge will be disclosed before payment.
Where a commercial condition provides that the 20 % deposit is non-refundable for a cancellation communicated more than seven days after confirmation, it must be expressly stated in the booking. Its application will be subject to the relevant legislation and proportionality limits, without excluding legally required refunds.
Times, building rules, visitors, pets, use of shared areas and possible security deposits will be communicated for each property. No security deposit or additional charge that has not been previously disclosed will be required.
The accommodation must be used in accordance with the agreed occupancy, community rules and facilities. Any damage must be documented and distinguished from normal wear and tear.
11. Consumer rights
These terms do not imply a waiver of rights recognised by applicable law.
Where a contract falls within Article 49 of the Brazilian Consumer Protection Code, the right to withdraw applicable to contracts concluded outside business premises will be respected, including the statutory seven-day period and corresponding refunds.
Deposit, cancellation or no-show clauses will not override mandatory rights.
Where a refund is due, its amount, payment method and applicable timeframe will be communicated. A financial institution's processing times will be disclosed when they affect the crediting of funds.
12. Documentation and participants' needs
The customer must provide accurate information and check the documents required for the activity, accommodation or trip.
Participation requirements for minors, authorisations and documentation will be communicated according to the booked service.
Accessibility or assistance needs should be discussed before confirmation so that the service's actual conditions can be assessed. Health data will only be requested when necessary and must be processed with the appropriate safeguards.
For physical or adventure activities, relevant restrictions and instructions will be provided. Acceptance does not imply a waiver of the participant's rights or release the provider from its safety obligations.
13. Privacy and personal data processing
We may receive information supplied when requesting information or booking, such as name, telephone number, email address, travel dates, number of participants and information necessary for the booking.
Identity documents and other additional data will only be requested when necessary for a specific purpose.
Processing may serve to answer enquiries, prepare proposals, manage bookings and payments, coordinate services, meet legal obligations or address complaints.
The appropriate legal basis will be used for each purpose. When consent is required, it must be requested specifically. The use of data for promotional communications will be distinguished from communications necessary to manage the booking.
14. Sharing, retention and security
Data necessary to fulfil a booking may be shared with the providers involved. Certain communication, payment or technology hosting platforms may also participate in its processing.
Sharing must be limited to the relevant purpose. Where an international transfer of data occurs, applicable legal requirements must be observed.
Data will be retained for the period necessary for its purposes and the corresponding legal obligations. At the end of that period, it must be deleted or anonymised, unless a legal basis exists for its retention.
Appropriate technical and organisational measures must be applied to reduce the risk of unauthorised access, loss or misuse.
Documents and payment receipts sent must be limited to those requested. Passwords, authentication codes and full card details must not be sent through messaging channels.
15. Personal data rights
Through the contact channels provided, the data subject may request information about the processing of their data, access, correction and, where applicable, deletion, anonymisation, blocking or portability.
They may also enquire about the entities with which data has been shared and withdraw consent where it is the basis for processing.
Handling a request may require proportionate identity verification. Its scope will be assessed in accordance with the law, including obligations that justify retaining certain data.
16. Cookies, external content and affiliate links
The website includes third-party links and content, such as maps, videos, social networks and booking platforms. Their use may involve data processing by those providers in accordance with their own policies.
Tools intended to remember preferences, measure visits or deliver advertising must be described in accordance with the website's actual configuration. Where processing requires consent, it must be obtained through an appropriate mechanism.
Some commercial links may generate a commission for Ernestinho Carioca. Where relevant, this relationship will be identified in the corresponding link or content.
Bookings made directly on an external platform will be governed by the terms disclosed by that platform, without prejudice to the responsibilities legally attributable to Ernestinho Carioca.
17. Content, photographs and customers' images
Ernestinho Carioca's original texts, designs and materials are protected under applicable law. Third-party materials retain the rights of their respective owners.
Promotional use of identifiable images of customers will require the appropriate authorisation. Booking a service does not, by itself, constitute authorisation to publish personal photographs or videos for advertising purposes.
18. Customer service, interpretation and updates
Enquiries and complaints may be submitted through the contact channels provided. A clear and documented solution will be sought, without limiting the customer's access to consumer protection authorities or competent courts.
Versions in other languages must retain the same meaning. Translation differences may not be used to reduce consumer rights.
This document may be updated to reflect changes to services or legislation. Changes will apply prospectively and will not retroactively alter a confirmed booking to the customer's detriment.
